Statutory Cancellation Rights
Where the statutory cancellation right applies to an online purchase of goods, the consumer will generally have 14 days after receiving the goods to notify the trader of the decision to cancel, without having to give a reason. The consumer will generally then have a further 14 days to return the goods. There are statutory exceptions to this right for certain types of goods.
Where an order contains goods delivered on different days, the statutory cancellation period may run from the date the final goods in that order come into the consumer's physical possession.
A cancellation notice must be communicated before the applicable cancellation period expires. The consumer may use this model form or another clear statement of cancellation.
Refunds Following Cancellation
Where a valid statutory cancellation applies, DNV21 LTD will process the applicable refund in accordance with UK law.
This will generally include the price paid and the applicable standard delivery charge. Where a customer selected a more expensive delivery service than the least expensive standard delivery option offered, the additional delivery cost may not be refundable.
Where permitted by law, DNV21 LTD may wait until the goods are returned or the customer provides appropriate evidence that the goods have been sent back before completing the refund.
Where legally permitted, a refund may be reduced to reflect any diminished value caused by handling beyond what was reasonably necessary to establish the nature, characteristics and functioning of the goods.
Exceptions
The statutory cancellation right does not apply to every purchase.
Certain goods can be excluded from the cancellation right where the applicable legal conditions are met, including certain goods that deteriorate or expire rapidly, bespoke/customised goods and certain sealed goods that are unsuitable for return for health protection or hygiene reasons once unsealed.
The fact that a product is food or drink does not by itself mean that every such product is automatically excluded. The applicable legal exception depends on the nature of the goods and the circumstances.
Separate statutory rights may apply where goods are faulty, damaged, incorrectly supplied or not as described. Nothing on this page removes or restricts those rights.
Damaged or Faulty Goods
For damaged, leaking, faulty, incorrect or missing products, please contact DNV21 LTD as soon as reasonably possible and, for delivery-related damage, preferably within 48 hours of delivery.
The 48-hour request is intended to help us investigate delivery-related problems quickly. It does not replace or reduce any statutory rights.
We may reasonably request photographs, packaging details, shipping information, quantity affected and other relevant evidence needed to investigate a claim.
Where reasonably necessary, we may require the affected goods to be returned, made available for collection or otherwise made available for reasonable inspection.
Any refund, replacement, partial refund or other remedy will be determined following review and in accordance with applicable law and our Return & Refund Policy.
